Terms & Conditions

The following Terms and Conditions govern any person or entity’s (the Users) use of this Site. By using or accessing www.charitystars.com, one is accepting and agreeing to be bound by the Terms and Conditions expressed in the following contract. If you do not agree to these Terms and Conditions, you may not access or otherwise use this Site.

 

  1. Registration eligibility. This Site, together with all content (including User Content), data and other materials contained in the Site (“Content”) is owned or controlled by VIP4AID Limited, a company registered in England with its registered office at Birchim Court, 20 Birchim Lane, London, EC3V 9DJ, United Kingdom. VIP4AID Limited is referred to in these terms and conditions as CharityStars. In registering with CharityStars, the User is forming a contract with the Site. By registering, the User is declaring to be of legal age and that that they are using the CharityStars platform outside their work realm. Please note that the User is legally required to be of 13 years of age or older, and age restrictions may vary according to the prize. In the majority of instances where the winner is under 18 years of age, they will have to be accompanied by an adult. In registering, the User is consenting to CharityStars using photos and camera footage of their participation in experiences and events. The User is consenting to these being used worldwide and without limitation rights, (in full or edited or amalgamated form) online and/or television broadcast, for media purposes.
  2. Passwords. You agree that you will be responsible to CharityStars and to others for all activity that occurs under your registration account. By registering the User has agreed to keep their password secure and confidential. Users are prohibited from aiding or assisting anyone who is not registered with CharityStars to gain access to any secured areas of the Site, create additional registration accounts for the purpose of abusing the functionality of the Site, or other Users, or to seek to pass yourself off as another User. If a User is concerned about the security of their account, they should email [email protected] immediately. The CharityStars team will ensure the account is shutdown immediately until the issues of security are resolved.
  3. Personal Information. The User must register with the CharityStars website and provide certain personalised information (name, surname, address, telephone number and email address the User can use their Facebook profile by using the Facebook Connect function. For information about the use of this personal data, Users must refer to the CharityStars Privacy Policy of this Application. In registering, the User has agreed to provide accurate and complete information that is required by the CharityStars Site.
  4. Content ownership. CharityStars owns all intellectual property that is projected on the Site, unless otherwise stated. The User is not permitted to extract, re-utilise or distribute any of the content on the Site (this includes storing it in any medium). The content on the Site is subject to UK national and local law; so only what is legally and expressly allowed may be used. The Site and the Content are for the User’s personal, non-commercial use only, and are not for re-distribution, transfer, assignment or sublicense or for any commercial or partly commercial re-sale or other use.
  5. Site Content. Please note that whilst CharityStars aims to ensure that all information is accurate and current, it will be subject to change and therefore CharityStars cannot be held accountable for inaccuracies and discrepancies. All Content is provided without any representations or warranties of any kind (implied or expressed) to the fullest extent permitted by applicable law. The Site is intended only for the purposes specified on the Site, and use of the Site and/or all Content contained within the Site (Content) is entirely at the Users own risk. CharityStars does not state that the Content will be without limitation viruses or other harmful elements. Certain Content may become temporarily unavailable due to outages or other problems.
  6. Disagreeable Material. If the User encounters or becomes aware of objectionable or unlawful content posted anywhere on the Site, please immediately report such material to [email protected].
  7. The Users use of the Site. In registering the User has entered a contract in which they have agreed not to use the Site or any of the Content for the solicitation of business or in connection with a commercial enterprise, not to solicit, for commercial purposes any other Users with respect to their submitted material, and not to access any Content on the Site for any reason other than their personal, non-commercial use solely via the normal functionality of the Site.
  8. Submission of material. All material uploaded to the Site (including written comments), the User is agreeing that it can be used worldwide, with a non-exclusive license. The User is granting the Site use of this material for any other third-party platforms, media channels and/or distribution or performance methods. The User is hereby waiving their moral rights for the purpose of this licence. CharityStars reserves the right to cut, edit, crop or arrange the Users material as necessary for purposes related to the Site, and to remove the material at any time.
  9. Prize Draws. On occasion CharityStars uses the Prize Draw on the Site. This Agreement, and where relevant any specific Prize Draw, is void if prohibited. CharityStars employees are prohibited from entering the Prize Draws.  By entering the Prize Draw, the User is confirming that all the personal information they entered on registration is accurate, current and complete. Any User who has not supplied the correct or relevant information may be disqualified from the Prize Draw. CharityStars maintains the right to disqualify a User if there are reasonable grounds to support fraudulence, inaccuracies or discrepancies in the information the User has supplied. Rules for entry to each Prize Draw are posted on the Site on the relevant webpage and may vary according to each Prize Draw.
  10. Prize Draw entry. CharityStars provides clear instructions on how to enter a Prize Draw, the User should follow the instructions posted in the relevant Official Rules for Prize Draw within the Site. The User may enter as many times as he/she wishes and when the deadline or maximum number of entries is reached, the Prize Draw will close. CharityStars reserves the right to change, cancel or suspend any Prize Draw without specifying reason, or to change these terms and conditions by notice on the Site (effective from the date and time of posting).  Additionally if a Prize Draw does not meet a fundraising target, CharityStars reserves the right to cancel a Prize Draw and all donations will be refunded on request. The User may enter a Prize Draw as many times as they wish, though CharityStars reserves the right in our absolute discretion to restrict the number of such entries in which you may participate or win.
  11. Free Prize Draw. Please note that this is a Free Prize Draw and no purchase is necessary in order to enter. Whilst a User may make a donation using an approved debit or credit card, or any other approved payment methods, alternatively, a User may also enter a Prize Draw by completing and posting the free entry form, which can be found in the Official Rules of each Prize Draw. CharityStars will accept only copy document, as originals cannot be returned. Entries sent by post must be received by CharityStars before the closing date and at the address specified in the Official Rules. It is the responsibility of the User to ensure delivery information and postage is correct. Entries must not be sent through agents, third parties or otherwise on the Entrant's behalf unless otherwise provided in the Prize Rules. Any entries which are above the maximum number of entries for the relevant method of entry, or which are incomplete or received after applicable deadline, will not be valid. Bulk entries are void and cannot be accepted.
  12. Prizes. A successful winner may be required to confirm their identity by sending a certified copy of their passport before a prize will be delivered or executed. Additionally, CharityStars reserves the right to ask winners to provide a personal photograph of which CharityStars can use for promotional purposes. CharityStars is permitted to substitute a payment of a reasonable amount of cash in lieu of any prize. Results of each Prize Draw will be posted on the Site following the closing date of the relevant Prize Draw.
  13. Selection of Winner. CharityStars uses a random number generator to determine each winner of the Prize Draw. In each case, CharityStars determinations on the competition will be final and no correspondence will be entered into. The winner will be notified via email, at which point CharityStars will enter a contract with the Winner (and shall include the terms made available via the Site for the relevant Prize Draw and any further terms reasonably determined by CharityStars and notified to Users in accordance with this Agreement). Additional information, if required, the winner shall have (30) days (or other date as set out in the applicable Prize Rules) to respond in full to the notification email with the additional information or an alternative winner may be selected. CharityStars are not responsible for winners who are unable to claim their prizes, failure to claim a prize within the given time period, may result in disqualification or selection of an alternative winner. If the Prize Draw offers the opportunity for the Winner to bring a guest, the necessary information for this guest must be provided on request. CharityStars reserves the right to disqualify any proposed guests.
  14. Prize Experience. Where relevant, in entering the Prize Draw, the User is confirming that they are available for travel or specific dates that will be stated in the description. If a circumstance arose where a prize became unavailable before or after the relevant Prize Draw has ended, CharityStars reserves the right to change or remove this. Entrants will be notified to have funds credited back to their accounts or we may substitute a cash prize. All goods and/or services won in any Prize Draw are non-negotiable and non-refundable and have a cash value of no more than the sum posted on the relevant page of the Site (if any) or as determined by CharityStars in its reasonable discretion. CharityStars could at any time substitute any such rights or goods with different rights or goods of similar and/or reasonable value. The rights and/or good(s) on offer shall be awarded by CharityStars subject to availability. Please note that (where applicable) all taxes and insurances and/or other expenses are the sole responsibility of the winner(s). The terms and conditions of any related third-party supplier or suppliers may apply and must be accepted by the winner. Where applicable, prizes will include regular/economy travel only from within the relevant country to the location of the Prize.
  15. Refunds and Credits. In cases where a donation is not accepted or honoured, a returned payment fee will be charged to the User to cover the administration costs of CharityStars. In specific cases, CharityStars reserves the right to block a User access to their account and/or to withhold any outstanding deliveries until payment in full of all applicable invoices is received.
  16. Termination of General Terms and Conditions Agreement. CharityStars maintains the right to terminate this contract if they feel it is no longer commercially viable, if they are legally required to or if a User is believed to have breached this agreement.
  17. Entire Agreement. This Agreement constitutes the entire agreement between the parties on the subject matter hereof. There are no understandings, agreements, or representations, oral or written, not specified herein regarding this Agreement.
  18. Liability. Under this agreement, Users are limited to the amount they have actually paid to CharityStars for its products or services during the (3) months immediately prior to the notification to the holder on a claim they wished to make. CharityStars shall not be liable for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of the Users practice on the Site or in relation to the goods and/or services that the Holder provides. Nothing in this Agreement shall operate to limit or exclude liability for death or personal injury caused by negligence of CharityStars.
  19. Disclaimer. The User agrees and accepts that CharityStars shall not be liable for any change, suspension or interruption to the Site or the service. The User has no legal right to receive any refund unless the Site is closed and unavailable for a continuous period of more than twelve months. CharityStars provides no warranty, due to unforeseen and external factors that may be out of CharityStars control. Technical issues during the Prize Draw, which affect the Site and Draw, may result in CharityStars stopping the timer and pausing the sales of Prize Draw tickets, until the problem has been resolved. All services and contents on the CharityStars Site are provided without representation or warranties of any kind, to the fullest extent permitted by applicable laws. In addition, we do not represent or warrant that the Site or its contents will be free of defects, including without limitation viruses or other harmful elements. 
  20. Hacking. In accessing the Site, the User has agreed not to undertake or attempt to interfere with the Prize Draw. This includes attempting to damage, hack, crack, deny service to, or collectively ‘interfere’ with the Site. Users have agreed to pay damages if they participate in any of the above behaviours. CharityStars will not hesitate to involve the authorities and they will actively work with them, in prosecuting any Users who participate in these prohibited activities. CharityStars reserves the right to deny access or service to any User for any reason, at any time. CharityStars may take any action they deem appropriate, with respect to violation and enforcements of the terms of this agreement. The holder expressly reserves all rights and remedies available to them at law or in equity.
  21. Indemnity. Any loss or damages that CharityStars may incur as a direct result of a User, that User having agreed to indemnify the Holder for limitation legal fees, arising from any breach by User of any warranty herein or User's misuse of any material or information obtained through the Site, is legally responsible. The User has further undertaken to indemnify CharityStars for all loss or damage incurred by CharityStars in relation to any third party claim against CharityStars for infringement of intellectual property rights arising in relation to any unauthorised or improper use of the Site or content.
  22. Trade Marks. All service names and brands, including products, appearing on the Site including, without limitation ‘CharityStars’, are the trademarks or trade names of CharityStars or its trading partners unless otherwise stated. Users may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trademarks, trade names or taglines without the prior written permission of CharityStars.
  23. No Partnerships. The User has agreed not to use the Site to create partnerships, professional relationships or attract clients.
  24. No Waiver. No waiver, express or implied, by either party of any term or condition or of any breach by the other of any of the provisions of this agreement shall operate as a waiver of any breach of the same or any other provision of this agreement.
  25. Severance. If any element of this agreement was found invalid in a Court of Law, all remaining portions or provisions within the document would remain valid.
  26. Variation. The User has accepted that this document may be altered and updated at points. The amendments will be active from the date and time at which they are posted on the Site. Acceptance of this is validated by a Users continuation to use their CharityStars account and the services provided.
  27. Law and Jurisdiction. This document is subject to the laws of England and Wales. It shall be governed by these, and any disputes that this document causes shall be subject to the jurisdiction of the English Courts. 

Visitor Agreement

On accessing www.charitystars.com, any person or entity (User), agrees to be bound by the following contract. This applies to all unregistered Users visiting the site.

  1. CharityStars. Please note that, whilst CharityStars endeavours to provide and host accurate and useful information, the Content may be inaccurate and is subject to change, often at very short notice. To the fullest extent permitted by applicable law, all Content is provided without any representations or warranties of any kind (either implied or expressed) and is not intended as specific commercial or legal advice. Specifically, CharityStars does not represent or warrant that the Site or the Content will be accurate, up-to-date, complete or free of defects, including (without limitation) viruses or other harmful.
  3. Featured links. The Site displays and/or refers to links to other websites from time to time. CharityStars (i) does not endorse or take responsibility for the content of such websites, (ii) is not responsible for the availability of such websites; and (iii) will not be liable in any way for any loss or damage which the User may suffer by using such websites. If the User decides to access linked websites, they should do so at your own risk.
  4. Links to CharityStars. Any other website may link to the Site, provided it links only to the homepage, does not imply any endorsement of its products or services by CharityStars, does not misrepresent its relationship with or present false information about CharityStars, does not infringe any intellectual property or other right of any person and complies with all relevant laws and regulations. Please note, however, that CharityStars reserves the right to withdraw such permission at any time and to take any other appropriate action.
  5. Use of content. A User of this Site may view any materials offered for such access via the Site for their own private viewing purposes only. A User may not publish, distribute, extract, re-utilise, or reproduce any part of the Site or its contents in any form (including storing it in any medium) other than as expressly allowed herein or as permitted by UK or local law.
  6. Ownerships of Content. CharityStars, unless otherwise stated, owns or controls all relevant rights in the Site and the content.
  7. Hacking. The User agrees not to attempt to damage, deny service to, hack, crack, reverse-engineer, or otherwise interfere (collectively, "Interfere") with the Site in any manner. If the User in any way interferes with the Site, the User has agreed to pay or refund all damages incurred by CharityStars. CharityStars will cooperate with the authorities in prosecuting any User who Interferes with the Site or otherwise attempts to defraud CharityStars or any other parties through User's use of the Site or services provided via the Site. CharityStars reserves the right to deny any or all access or service to any User for any reason, at any time, at CharityStars sole discretion. User agrees that CharityStars may block User’s IP address or addresses at any time, disallow the User's continued use of the Site without giving them any advance notice. CharityStars reserves the right to take any action they may deem appropriate in their sole discretion with respect to violations or enforcement of the terms of this Agreement, and CharityStars expressly reserve all rights and remedies and remedies available to us at law or in equity.
  8. Complaints. If a User believes that you are the owner of the copyright or other rights in any material(s) appearing on CharityStars, and/or that ownership of the copyright or other rights in any material has been incorrectly used or represented on CharityStars, please contact us via [email protected].
  9. Trade marks. The brands, products and service names used in this Site (including without limitation, “CharityStars”) are the trade marks or trade names of CharityStars or its trading partners unless otherwise stated. Users may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trade marks, trade names or taglines without the prior written permission of CharityStars.
  10. Registration. On registering with the Site, a User must: agree to the terms of the Terms and Conditions; agree to keep their password secure and confidential and not allow anyone else to use their email address or password to access the Site; agree not to do anything which would assist anyone who is not a registered User to gain access to any secured area of the Site; and agree not to create additional registration accounts for the purpose of abusing the functionality of the Site, or other Users, or to seek to pass themselves off as another User.
  11. Limitation of liability. User agrees that the liability of CharityStars to User under this Agreement shall be limited to the greater of the amount User has actually paid to CharityStars for its services and £100. Nothing in this Agreement shall operate to limit or exclude liability for death or personal injury caused by negligence of CharityStars.
  12. Indemnity. User agrees to indemnify CharityStars for any loss or damage that may be incurred by CharityStars, including without limitation legal fees, arising from User's use of the Site or User's use of any information obtained through the Site.
  13. Severability. If any part, term, or provision of this Agreement shall be held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any relevant law, the remaining portions or provisions shall still remain valid and continue in full force and effect.
  14. Changes to this agreement. This Agreement and/or any other terms of service may be changed without prior notice, and any such amendment will be applicable to all Users from the date and time such revised terms have been posted on the Site. User’s continued use of the Site or services constitutes agreement with and acceptance of any such amendment or other changes.
  15. Law and jurisdiction. This Agreement shall be governed by and will be construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the English Courts.

Official Rules

No purchase necessary to register for or use www.charitystars.com. Neither a purchase nor donation will increase your chances of winning. The entities featured on the website for which donations are solicited or funds are raised are recognised non-profit organisations.

Although promotion type promotions (each a ‘promotion’) are offered on the website as an extra benefit for users, the website is not a promotion and Users may enter any promotion at any time without payment by completing a minor activity.

Each promotion has its own individual promotion rules as well. In the event of a conflict between the governing rules and the promotion rules, the promotion rules govern.

The Promotions (as defined below) consists of a sweepstakes. The Promotions are sponsored by VIP4AID Limited. (the “Sponsor”).

  1. Entry. No purchase or donation necessary to enter or claim prize. Participants may enter the Prize Draw by visiting the raffle page at www.charitystars.com (the ‘promotion website’) and clicking on the relevant Prize Draw, during the promotion period and donating to the benefitting charity by following the on-screen prompts. The donation system will be tiered; donation minimum and maximum amounts are specified by CharityStars (each a ‘donation’). The number of entries a User receives per pound of their donation will be posted at the Entry Site. The User must have a valid method of payment to enter by this method. The User’s submissions must be received between the dates posted at the Entry Site (the Entry Period). Unless alternative instructions are set forth in the promotion rules, to enter without a donation the User should send their name, postal address, telephone number, email address if applicable and the Prize Draw they wish to enter, to 50 Liverpool Street, London, EC2M 7PY. The envelope must be post marked no later than the last day of the entry period and must be received by CharityStars no later than 5 working days after the deadline. Enter as many times as you wish, but each entry must be mailed separately. The User’s submissions must be received during the Entry Period. To enter without a donation the User should fill out and mail in this form. The envelope must be post marked no later than the last day of the Entry Period and must be received by CharityStars no later than 5 working days after the deadline.   2. Prizes. A description of the prize and prize restrictions will be posted at the Entry Site. The prize description shall be deemed an official part of these official rules and are incorporated by reference herein. In addition to the donation level gifts identified in Section 1 above, one (1) winner of the Prize Draw (the ‘Prize Draw Winner’) and one (1) guest (if applicable) will have won the prize stated in the prize description. The prize cannot be substituted or transferred, except by CharityStars at their sole discretion. Each winner of a prize or recipient of a donation gift is responsible for reporting and paying all taxes associated with his/her receipt of such prize or donation gift. Sponsor will withhold and/or report taxes as required by the applicable law of Sponsor’s jurisdiction and winner’s jurisdiction. The winners will not receive the difference between the actual retail value and approximate retail value. The odds of winning depend on the number of eligible entries received. Sponsor reserves the right to substitute prizes of equal or greater value. No other substitution or transfer of prizes is permitted, and prizes cannot be redeemed for cash. Sponsor is responsible only for prize delivery and not prize utility. The prize cannot be substituted or transferred, except by CharityStars at their sole discretion.
  3. Eligibility. Most Promotions are only open to individuals who are at least fourteen (14) years of age at the time of entry. If a user under the age of eighteen (18) wins the prize, then they must be accompanied by an adult over the age of eighteen (18) with the sweepstake winner's parental consent. Regrettably, while anyone is free to make a donation to the Charity, residents of certain countries will be unable to enter in the Contest for a variety of reasons, which include local sweepstakes and contest laws and compliance legislation. These countries/provinces are Burma/Myanmar, Cuba, Iran, Libya, North Korea, Sudan, Syria, Quebec, Saudi Arabia, Iraq, Jordan, Lebanon, Qatar, Yemen and all African nations with the exception of South Africa. Other countries are void where prohibited. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. By participating in the Promotion, each participant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of Sponsor and warrants that she/he is eligible to participate in the Promotion. Employees, independent contractors, officers, and directors of Sponsor, affiliates, subsidiaries, advertising, promotion, and fulfilment agencies, and legal advisors, and their immediate family members and persons living in the same household, are not eligible to participate in the promotion. THE PROMOTION IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to applicable federal, state and local laws and regulations.
  4. Selection of Winners. Selection of Winners. Five (5) working days after the deadline of the Entry Period, CharityStars will select the Prize Draw winner. The Winner will be selected in a random drawing from all eligible entries received by the Sponsor during the Promotion Period. The Winner will be notified by e-mail, or an another suitable means of communication, using the information provided to the Sponsor and will also be announced on the Promotion Website. CharityStars is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify the winners. The winners agree to Sponsor’s use of her/his name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law. Where lawful, the winners may be required to sign and return a Declaration of Compliance, Liability and Publicity Release. At CharityStars discretion, a background check may be performed which the Winner would have to pass in order to fulfil his or her reward. If any potential winner of the Sweepstakes is a Canadian resident he/she will be required to answer a time limited skill testing question without assistance, in order to be eligible to receive a prize. In the event any of the winners cannot be contacted, fails to sign and return the Declaration of Compliance, Liability and Publicity Release or fails provide any other requested information, does not accept the applicable prize within 72 hours of being notified by Sponsor, fails to answer the skill-testing question correctly (if applicable), the winner is ineligible, or the applicable prize or prize notification is not deliverable, potential winner forfeits the prize. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner.
  5. Conditions. CharityStars, the charity and their respective agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfilment agencies, and legal advisors (the “Released Entities”), are not responsible for, shall not be liable for, and hereby disclaim all liability arising from or relating to: (i) late, lost, delayed, damaged, misdirected, misaddressed, incomplete, or unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, computer or other malfunctions, failures, or difficulties of any kind, whether human or technical; (iii) failed, incomplete, garbled, or delayed computer or e-mail transmissions; (iv) any condition caused by events beyond the control of Sponsor; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize, or any portion thereof that may have been awarded, or acceptance, possession, or use of any prize, or any portion thereof that may have been awarded, or from participation in the Promotion; or (vi) any printing or typographical errors in any materials associated with the Promotion. Sponsor reserves the right, in its sole discretion, to suspend, modify or cancel the Promotion should any unauthorized human intervention or other causes beyond Sponsor’s control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In the event that proper administration of the Promotion is prevented by such causes as contemplated above, Sponsor will pick the winners from all eligible, non-suspect entries received prior to such action. By participating in the Promotion, participants and winners agree to release, discharge and hold harmless the Released Entities, and all others associated with the development and execution of the Promotion, from any and all losses, damages, rights, claims and actions of any kind arising out of or relating to the Promotion, participation in the Promotion, any prize, or any portion thereof that may have been awarded, and/or acceptance, possession, use or misuse of any prize, or any portion thereof that may have been awarded, including but not limited to statutory and common law claims for misappropriation or participant’s right of publicity. This Promotion shall be governed by UK law. By participating in this Promotion, participants agree that the British courts shall have jurisdiction over any dispute or litigation arising from or relating to this Promotion and that venue shall be only in the UK. If the winner is unable for whatever reason to attend the prize experience then the Sponsor may select another winner using the random number generator.
